Punishment for Drug Offenses: Misdemeanor possession of a controlled substance or paraphernalia carries a range of punishment of up to one year in jail and/or a fine not to exceed $1,000. Felony possession of a controlled substance is a class D felony and carries a punishment not to exceed a fine of $5,000 and/or a jail sentence not to exceed 1 year or a prison sentence not to exceed 7 years. Distribution of drugs may have varying degrees of punishment depending on if the charge is filed as a class C, class B or class A felony. The class D felony of distribution carries a punishment not to exceed a fine of $5,000 and/or a jail sentence or prison sentence. The jail sentence may not exceed one year and the prison sentence may be up to 7 years.
